Customer Complaint Policy

It is the policy of our company to respond to customer complaints, disputes and issues immediately, to take each complaint seriously, to investigate each complaint however small it is – immediately and to take remedial actions swiftly.

Our Complaint Process:

Immediate Documentation:
As soon as a complaint is received, it is documented and is logged into a special log. The complaint is sent directly to the Customer Complaint Officer or his designate, in order to take action.

Record Keeping:
All complaints and records of complaints are kept in a special complaints binder along with all the Customer Complaint Officer's Quality Control Files and other written policies so employees can easily access them and use them to provide better customer service.

Management Review:
Reports on complaints are reviewed during the Customer Complaint Officer's meetings with our Board.

Important Consumer Rights

Right to Shop:
You are not required to use any particular lender, mortgage broker, or other provider of settlement services. You have the right to shop for the best terms and lowest cost for the mortgage loan and settlement services.

Prepayment Penalties:
Texas law limits prepayment penalties on certain home loans. You should ask your loan officer whether your loan will include a prepayment penalty and review your loan documents carefully.

Home Equity Loans:
If you are obtaining a home equity loan under Section 50(a)(6), Article XVI of the Texas Constitution, you have specific rights including:

  • The right to a 12-day waiting period before closing after receiving your final loan application
  • Protection against excessive fees (fees generally cannot exceed 3% of the loan amount)
  • The right to rescind the loan within 3 days after closing
  • Limitations on the total amount you can borrow (generally 80% of your home's fair market value)

Reverse Mortgage Counseling:
Texas law requires that before you can obtain a reverse mortgage (also called a home equity conversion mortgage), you must receive counseling from an independent third-party counselor approved by the U.S. Department of Housing and Urban Development.
